Welcome! This is Papa’s Pizza & Barbecue Pit Management, LLC’s ("Papa’s Pizza" "our" "we" "us") Privacy Policy ("Privacy Policy") which applies to our family of websites, mobile sites, interactive features, applications and downloads that are operated by us and available through our websites and post this Privacy Policy (collectively "Sites") whether you access the Sites via personal computers, mobile devices, tablets, or other technology (each a "Device"). We have established this Privacy Policy to let you know the kinds of personal information we may gather during your visit to our Sites, what we use your personal information for, when we might disclose your personal information, and how you can manage your personal information.

This Privacy Policy does not cover any information we may collect at other websites, that our local independent owners may collect at independently owned websites, or offline by us (unless we specifically provide otherwise). Please also review our Terms of Use, which governs your use of the Sites and any content you submit to the Sites.

1. Information Collected Out on Sites

a. Personal and Demographic Information. We may ask you to provide us with certain categories of information including: (1) personally identifiable information, such as your name, e-mail address, birth date, credit card number, and physical address ("Personal Information"); and (2) demographic information, such as gender, zip code, or similar information ("Demographic Information"). We may collect this information through various forms and places on the Sites, including account registration forms, newsletter sign-ups, gift card order forms, franchise inquiry forms, resume submission forms, contact us forms, and when you otherwise communicate with us via the Sites. If we combine Demographic Information with Personal Information we collect, we will treat it as Personal Information under this Privacy Policy. Of course, you are free to visit our Sites without providing any Personal Information or Demographic Information but some parts of the Sites may not be available to you if choose note to provide this information.

b. Anonymous Information. When you interact with our Sites, our servers may keep an activity log that does not identify you individually ("Anonymous Information"). We collect and store certain administrative and traffic information with each use of the Sites including: source IP address, time of access, date of access, web page(s), type of browser used, access times and referring websites addresses. If we associate Anonymous Information with you as a specific person, we will treat it as Personal Information.

c. Device Identifiers. We automatically collect your IP address or other unique identifier ("Device Identifier") for your Device used to access our Sites. A Device Identifier is a number that is automatically assigned to your Device used to access the Sites, and our computers identify your Device by its Device Identifier. Some mobile service providers may also provide us or other third party service providers with information regarding the physical location of the Device used to access the Sites.

2. Technology Used on Our Sites

a. Cookies. We may use cookies, which are small data files placed on a Device when it is used to visit the Sites. A Flash cookie is a data file placed on a Device via the Adobe Flash plug-in that may be built-in to or downloaded by you to your Device. Most web browsers automatically accept cookies, but, if you prefer, you can usually modify your browser setting to decline cookies. b. Web Beacons. We may use "Web Beacons" which are small graphic images or other web programming code (also known as "1x1 GIFs" or "clear GIFs") in our web pages and e-mail messages. Web Beacons may be invisible to you, but any electronic image or other web programming code inserted into a web page or e-mail can act as a Web Beacon.

c. Embedded Script. We may use embedded script which is programming code that is designed to collect information about your interactions with the Sites, such as the links on which you click. The code is temporarily downloaded onto your Device from our web server or a third party service provider, is active only while you are connected to the Sites, and is deactivated or deleted thereafter.

3. Information We Receive From Third Parties About You

We may supplement the information we collect about you on the Sites with outside records from third parties, such as leads received from franchisee referral websites, in order to enhance our ability to serve you, to tailor our content to you and to offer you opportunities to purchase products or services that we believe may be of interest to you. We may combine the information we receive from those sources with information we collect through the Sites. In those cases, we will apply this Privacy Policy to any Personal Information received, unless we have disclosed otherwise.

4. How Use the Information Collected on the Sites

a. We use Anonymous Information to help us determine how people use parts of the Sites and who our users are so we can improve your experience. We may also use Anonymous Information to provide statistical information in aggregated form to our partners and other third parties about how our users collectively use the Sites. We may also use or share Anonymous Information (or other information, other than Personal Information) in any other manner that we deem appropriate or necessary.

b. We may use information collected through our Sites, including Personal Information and Demographic Information: (i) to provide you with information or services or process transactions that you have requested or agreed to receive, including to send you electronic newsletters; (ii) to provide you with special offers or promotional materials on behalf of us or third parties; (iii) to enable you to participate in a variety of the Sites’ features, such as contests and sweepstakes; (iv) to improve the Sites and to customize your experience on the Sites; (v) to contact you with regard to your use of the Sites and, in our discretion, changes to the Sites and/or Sites’ policies; (vi) for internal business purposes; and (vii) for purposes disclosed at the time you provide your information or as otherwise set forth in this Privacy Policy.

Please note that information submitted to the Sites via a "contact us" or other similar function may not receive a response.

5. When and Why We May Disclose Information to Third Parties

a. We may disclose Anonymous Information, such as aggregated user statistics, with third parties. We do not share your Personal Information with third parties for those third parties’ marketing purposes unless you consent to such sharing at the time you provide your Personal Information. We may share your Personal Information with a franchisee to respond to a franchisee-specific inquiry you submit to us via the Sites. We may share the information we have collected about you, including Personal Information, Anonymous Information and Demographic Information, as disclosed at the time you provide your information and as described below or otherwise in this Privacy Policy.

b. Third Parties Providing Services On Our Behalf. We may use third parties, partners and affiliates to perform certain functions on our behalf, such as hosting the Sites, designing and/or operating the Sites’ features, tracking Site analytics, performing e-commerce functionality, sending e-mail newsletters or performing other administrative services. We may provide these entities with access to user information, including Personal Information, to carry out the services they are performing for you or for Papa’s Pizza.

c. Sweepstakes and Contests. If you choose to enter a sweepstakes or contest offered on our Sites, we may disclose Personal Information to third parties or the public in connection with the administration of such contest or sweepstakes, including, without limitation, in connection with winner selection, prize fulfillment, and as required by law or permitted by the official rules, such as on a winners’ list.

d. Administrative and Legal Reasons. We may transfer and disclose your information, including Personal Information, Anonymous Information and Demographic Information, to third parties: (i) in the event we are required to respond to subpoenas or other legal process or if in our opinion such disclosure is required by law; (ii) at the request of governmental authorities conducting an investigation; (iii) to protect and/or defend the Sites’ Terms of Use or other policies applicable to the Sites; or (iv) to protect the personal safety, rights, property or security of any individual. We may also use IP Address or other Device Identifiers to identify users, and may do so in cooperation with copyright owners, internet service providers, wireless service providers or law enforcement agencies in our discretion. Such disclosures may be carried out without notice to you.

e. Business Transfer. We may share Personal Information and Demographic Information with our franchisees, and our affiliated and related entities for internal business purposes. We also reserves the right to disclose and transfer all information related to the Sites, including, without limitation, your Personal Information and Demographic Information and Anonymous Information: (i) to a subsequent owner, co-owner or operator of the Sites or applicable database; or (ii) in connection with a corporate merger, consolidation, restructuring, the sale of substantially all of Papa’s Pizza’s stock and/or assets or other corporate change, including, without limitation, during the course of any due diligence process.

6. Participating in Public Areas

The Sites may provide message boards, comment areas and other "public" forums for sharing information or discussing various topics (collectively, "User Forums"). Please remember that any information you share in User Forums becomes public, and therefore this Privacy Policy does not apply to any information you choose to make public. Please be careful about what you disclose and do not post any Personal Information that you expect to keep private.

7. Communications; Unsubscribe

"STOP" or such other message that may be provided. However, even if you opt-out from receiving our newsletters or other promotional communications from us, we reserve the right to send you certain communications relating to our Sites, such as service announcements, notices of changes to this Privacy Policy or our Terms of Use or similar administrative or transactional messages, without offering you the opportunity to opt-out of receiving such messages.

8. Third Party Sites

The Sites may include links to other web sites that are operated and controlled by third parties ("Third-Party Site"). These Third-Party Sites may collect their own Anonymous Information or solicit and collect Personal Information. Papa’s Pizza is not responsible for the practices or content of any Third-Party Site. The Sites may also allow certain interactions between the Sites and your account on a Third-Party Site. The use of this functionality may involve the Third-Party Site providing certain information, including Personal Information, to the Sites.

9. Visitors Residing Outside the United States and Consent to Transfer

Visitors who use the Sites and reside outside the United States do so on their own initiative and are responsible for compliance with local laws, if and to the extent local laws are applicable. If you are located in the European Union, Canada or elsewhere outside of the United States, please be aware that any information you provide to us will be transferred to the United States. By using the Sites or providing us with your information, you fully understand and clearly and intentionally consent to this Privacy Policy and to the collection, storage, and processing of such information in the United States.

10. What Parents Should Know About Children

The Sites are general audience web sites and we do not knowingly collect any Personal Information from children younger than the age of thirteen (13). We will delete any Personal Information collected that we later determine to be from a user younger than the age of thirteen (13). Note that our Sites may feature a kids section where children can participate in games and activities without the collection of Personal Information.

11. Our Security

We incorporate commercially reasonable safeguards to help protect and secure your Personal Information. However, no data transmission over the Internet, wireless transmission or electronic storage of information can be guaranteed to be 100% secure. Please note that we cannot ensure or warrant the security of any information you transmit to us, and you use our Sites and provide us with your information at your own risk.

12. Changes to the Privacy Policy

We reserve the right to change this Privacy Policy at any time without notice to you. Any changes will be effective immediately upon the posting of the revised Privacy Policy. However, we will not use your Personal Information in a manner materially different than what was stated at the time it was collected without your consent.
